These Terms of Service (“Terms”) govern all contracts, agreements, and interactions between you (“you,” “User,” or “Customer”) and Empirio UG (haftungsbeschränkt) (hereinafter referred to as “empirio,” “we,” “us,” or “our”) relating to the services offered on the website www.gothesis.com (the “Website” or “GoThesis”). By accessing or using the Website, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms or our Privacy Policy, you are not permitted to use the Website or any services provided therein.
The following provisions govern the contractual relationship between empirio and its Users and Customers. They apply to all services provided by empirio through the Website, including both free and paid features. By using any part of the Website, you acknowledge that you have read and agree to these Terms. If you do not agree, you must discontinue your use of the Website.
1. Registration on the Website is free of charge. When you create an account, you may access certain software tools and other online services aimed at supporting academic or study-related work. By registering for a free account, you enter into a non-binding agreement with empirio that allows you to use our free services, such as using AI-based tools.
2. A free-of-charge contract with empirio via the website gothesis.de is established at the latest upon use of its functionalities. A paid contract in accordance with § 312 j BGB is formed when you click a button that clearly indicates a payment obligation — such as “Buy” or “Pay”. By doing so, you agree to pay the specified price for the selected service.
3. Registration on the www.gothesis.com website takes place by e-mail using a largely automated process. The customer must ensure that the e-mail address provided for registration is correct in order to be able to receive the e-mails sent to the customer by the service provider at the customer's address. In the event that the customer uses a spam filter, the customer must ensure that all third parties commissioned by the service provider or its vicarious agents to process the order can send e-mails to the customer without errors. Otherwise, it will not be possible to register and utilise the chargeable services on the www.gothesis.com website.
1. Right of cancellation
The customer, who is a consumer within the meaning of § 13 BGB, can cancel the contract in writing (e.g. letter, fax, e-mail) within 14 days without giving reasons. The cancellation period begins after receipt of this instruction in text form, but not before conclusion of the contract. 2. Consequences of cancellation
In the event of an effective cancellation, the services received by both parties must be returned and any benefits derived (e.g. interest) surrendered. If the customer is unable to return the service received in full or in part or only in a deteriorated condition, the customer must compensate the service provider for the loss in value.
If the customer cancels the contract, the service provider must reimburse the customer for all payments that the service provider has received from the customer, including any delivery costs, immediately and at the latest within fourteen days of the day on which the service provider receives notification of your cancellation of this contract. For this repayment, the service provider shall use the same means of payment that the customer used for the original transaction, unless expressly agreed otherwise with the customer; in no case shall the customer be charged any fees for this repayment. The service provider may refuse repayment until it has received the goods back or the customer has provided proof that they have returned the goods, whichever is the earliest.
3. Special notes on the right of cancellation
The customer's right of cancellation expires prematurely if the contract has been completely fulfilled by both parties at the express request of the customer before the customer has exercised his right of cancellation.

All prices displayed on the Website are stated in U.S. dollars (USD). Unless otherwise specified, these prices include all applicable taxes (for example, sales tax) relevant to your location in the United States. You may pay using recognized payment methods such as credit cards (Visa, Mastercard), PayPal, or Stripe. We reserve the right to modify or discontinue accepted payment methods at any time.

We shall not be liable for any indirect, consequential, incidental, special, or punitive damages that arise from or relate to these Terms or your use of the Website.
Any liability on the part of empirio for claims in connection with the Website or its services shall be limited to the amount you have paid for those services, if any. Nothing in these Terms excludes liability for gross negligence, willful misconduct, or any other liability that cannot be excluded under applicable law.

The law of the Federal Republic of Germany shall apply to all legal relationships between the service provider and the buyer, excluding the laws on the international sale of goods (UN Convention on Contracts for the International Sale of Goods). In the case of consumers, this choice of law shall only apply insofar as the protection granted is not withdrawn by mandatory provisions of the law of the country in which the consumer has his habitual residence.
2. If the customer is a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contract shall be the registered office of the service provider. The same shall apply if the customer has no general place of jurisdiction in Germany or the EU or if the customer's place of residence or habitual abode is unknown at the time the action is filed. This shall not affect the right to appeal to the court at another legal place of jurisdiction.
Each time you access the Website, our servers automatically collect limited, non-personal data, such as your IP address and cookies, and store this information in server logs. These logs are necessary to ensure the functionality of the Website and to deliver certain third-party advertisements.
We process and store data in accordance with our Privacy Policy, which describes how we handle personal information. We cannot control how third-party websites handle any information you may provide to them, and we disclaim responsibility for any actions or policies of third-party websites.

These Terms remain in effect for as long as you use the Website or maintain an account with us. You may terminate your account at any time by following the instructions provided on the Website or by contacting info@gothesis.com.
We reserve the right to terminate or suspend your account, or restrict your access to the Website, at any time and for any reason, including a breach of these Terms, without prior notice or liability. Provisions of these Terms that should reasonably survive termination (such as liability limitations and governing law) will remain in effect after termination.
We strive to keep the Website and our services continuously available, but we do not guarantee uninterrupted access. We are not liable for damages resulting from technical disruptions, data transmission errors, or other issues beyond our reasonable control. The Website may contain links to third-party content, and we are not responsible for the legality or accuracy of any such content, nor for the policies or actions of third-party sites.
We take the protection of your personal data seriously. All personal data is collected, processed, and used in compliance with our Privacy Policy and applicable U.S. privacy regulations.
